  5. A statement of accuracy — A statement, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your signature — A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include the following:

  1. Identification of the removed material — A description of the material that was removed or disabled and the location where it appeared before it was removed.
  2. A statement under penalty of perjury — A statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your signature — A physical or electronic signature.

Our Response Process

Upon receiving a valid DMCA takedown notice, we will take the following steps: promptly remove or disable access to the allegedly infringing material; notify the content provider, member, or user that we have removed or disabled access to the material; and if we receive a valid counter-notification, we will forward it to the original complainant and restore the removed material within 10 to 14 business days, unless the copyright owner files a court action against the content provider.

Repeat Infringers

OpenInEarn has adopted a policy of terminating, in appropriate circumstances, accounts or access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
